Terms and Conditions

  1. These Terms and Conditions define the general conditions, rules and manner of providing by ....  headquartered in ..... of services by electronic means, through the website .......pl (hereinafter: "Website").

§1 Definitions

  1. Password – means a string of letters, digits or other characters selected by the User during Registration on the Website, used to secure access to the User Account on the Website.
  2. Consumer – means a natural person making a legal transaction not directly related to his business or professional activity.
  3. User Account – means a panel customized for each User, launched on his behalf by the Service Provider, after the User registers.
  4. Terms and Conditions – means these Terms and Conditions of the Website.
  5. Registration – means an action performed in the manner specified in the Terms and Conditions, required for the User to use all functionalities of the Website.
  6. Website Pages – means the web pages under which the Service Provider operates the Website, operating in the domain ......pl.
  7. Service Provider – means..... headquartered in ..... NIP: ......, REGON: ......, entered in the Register of Entrepreneurs of the National Court Register kept by...... under the KRS number ......, with the share capital of PLN ......; e-mail: ......@.......pl, which is also the owner of the Website.
  8. User – means an entity using the functionality of the Website, for which services are provided by the Service Provider.

§2 General Provisions and Use of the Website

  1. All rights to the Website, including property copyrights, intellectual property rights to its name, Internet domain, Website Pages, as well as to templates, forms, logos belong to the Service Provider, and the use of these rights may be carried out only in the manner specified and in accordance with the Terms and Conditions.
  2. The Service Provider shall endeavour to make the use of the Website possible for Internet Users using all popular web browsers, operating systems, device types and Internet connection types. The minimum technical requirements for using the Website are a web browser of at least Internet Explorer 11 or Chrome 39 or Firefox 34 or Opera 26 or Safari 5 or later, with Javascript enabled, cookies accepted, and an Internet connection of at least 256 kbit/s. The Website is responsive and dynamically adjusts to any screen resolution.
  3. The Service Provider uses the cookie files mechanism, which the files are saved by the Service Provider's server on the hard drive of the User's terminal device when the User uses the Website. The use of cookies is aimed at the proper operation of the Website on the Users' terminal devices. This mechanism does not damage the User's terminal device and does not cause configuration changes to the Users' terminal devices or in the software installed on these devices. Each User may disable the cookies mechanism in the web browser of his terminal device. The Service Provider indicates that disabling cookies may, however, make it difficult or impossible to use the Website.
  4. In order to create a User Account on the Website, it is necessary for the User to have an active e-mail account.
  5. It is forbidden for the User to provide content of an unlawful nature and for the User to use the Website, its pages or services provided by the Service Provider in a manner contrary to the law, good morals, violating the personal rights of third parties or the legitimate interests of the Service Provider.
  6. The Service Provider declares that the public nature of the Internet and the use of services provided electronically may entail the risk of obtaining and modifying Users' data by unauthorized persons, and therefore Users should use appropriate technical measures to minimize the aforementioned risks. In particular, they should use anti-virus and identity protection programs for Internet users. The Service Provider never asks Users to provide the Password in any form.

§3 Registration

  1. In order to create a User Account, the User is obliged to register.
  2. For Registration, the User should complete the registration form made available by the Service Provider on the Website and send the completed registration form electronically to the Service Provider by selecting the appropriate function found in the registration form. During Registration, the User sets an individual Password.
  3. When filling out the registration form, the User has the opportunity to read the Terms and Conditions, accepting their content by marking the appropriate box in the form.
  4. During the Registration, the User may voluntarily consent to the processing of his personal data for marketing purposes by checking the appropriate box on the Registration form. In such case, the Service Provider shall clearly inform about the purpose of collecting the User's personal data, as well as about the known or anticipated recipients of such data. Giving consent means, in particular, consent to receive commercial information from the Service Provider to the User's e-mail address provided in the registration form.
  5. The User's consent to the processing of his personal data for marketing purposes does not condition the possibility of concluding a contract with the Service Provider for the electronic provision of the User Account service. The consent may be withdrawn at any time by submitting an appropriate statement of the User to the Service Provider. The statement may, for example, be sent to the Service Provider's address via e-mail.
  6. After submitting the completed registration form, the User shall immediately receive, by e-mail to the e-mail address provided in the registration form, confirmation of the Registration by the Service Provider. As of this moment, the contract for electronic provision of the User Account service is concluded, and the User obtains the possibility to access the User Account and the services made available within the User Account.

§4 Services

  1. The Service Provider provides the following electronic and gratuitous services to Users on a 24/7 basis:
      1. Newsletter;
      2. User Account maintenance;
      3. Content posting.
  2. The Service Provider reserves the right to choose and change the type, forms, time and manner of granting access to the selected listed services, of which it shall inform the Users in the manner appropriate for changing the Terms and Conditions.
  3. The Newsletter service consists of sending by the Service Provider, to the e-mail address, of messages in electronic form containing notifications about new information posted within the Website. The newsletter is sent by the Service Provider to all Users who have subscribed.
  4. The Newsletter service may be used by any User who enters his e-mail address, using the registration form provided by the Service Provider on the Website.
  5. The User may unsubscribe from the Newsletter at any time by unsubscribing via the link provided in each email sent as part of the Newsletter service.

§6 Withdrawal from the contract

  1. Consumer users who have entered into a contract for the provision of electronic services may withdraw from the contract within 14 days without stating a reason.
  2. The time limit runs from the date of conclusion of the contract for the provision of services by electronic means.
  3. The User may withdraw from the contract for the provision of electronic services by submitting a withdrawal statement to the Service Provider. The statement may be submitted on a form, the template of which is posted by the Service Provider on the Website at the following address: Withdrawal Form. To meet the deadline it is sufficient to send the statement before its expiration.
  4. In the event of withdrawal from the contract for the provision of electronic services, it is considered not concluded.

§7 Protection of personal data

  1. The Controller of Users' personal data provided to the Service Provider voluntarily within the framework of Registration is the Service Provider.
  2. The Service Provider processes Users' personal data in order for the Service Provider to provide electronic services and other purposes specified in the Terms and Conditions. The data is processed only on the basis of the law or the consent given by the User.
  3. The personal data set provided to the Service Provider is reported by the Service Provider to the General Inspector for Personal Data Protection.
  4. Personal data provided to the Service Provider is given to it voluntarily, with the proviso, however, that failure to provide the data specified in the Terms and Conditions during the Registration process prevents Registration and the creation of a User Account.
  5. Anyone who provides the Service Provider with his personal data has the right to access and correct it.
  6. The Service Provider provides the possibility of deleting personal data from its data set, in particular in case of deletion of the User Account. The Service Provider may refuse to delete personal data if the user has violated applicable laws, and the preservation of personal data is necessary to clarify these circumstances and determine the responsibility of the User.
  7. The Service Provider protects the personal data provided to it and makes every effort to secure it from unauthorized access or use. The set of collected personal data of Users is treated as a separate database, stored on the Service Provider's server, in a special security zone ensuring proper protection.

 

§8 Termination of contract

  1. Both the User and the Service Provider may terminate the contract for the provision of electronic services at any time and without giving reasons, subject to the preservation of the rights acquired by the other party before the termination of the aforementioned contract and the provisions below.
  2. The User terminates the contract for the provision of electronic services by submitting an appropriate statement of intent, using any means of remote communication that allows the Service Provider to learn about the User's statement of intent.
  3. The Service Provider shall terminate the contract for the provision of electronic services by sending to the User an appropriate statement of intent to the e-mail address provided by the User during Registration.

 

§9 Final provisions and amendment of the Terms and Conditions

  1. The Service Provider shall be liable for non-performance or improper performance of the contract; however, for contracts concluded with Business Users, the Service Provider shall be liable only with respect to intentional damage and within the limits of actual losses incurred by the Business User.
  2. The content of these Terms and Conditions may be recorded by printing, saving to media or downloading at any time from the Website.
  3. If a dispute arises under the concluded contract for the provision of electronic services, the Parties shall seek to resolve the matter amicably. The governing law for the resolution of any disputes arising under these Terms and Conditions shall be Polish law.
  4. Any User may use out-of-court means of handling complaints and claims. In this regard, it is possible for the User to use mediation. Lists of permanent mediators and existing mediation centers are provided and made available by the Presidents of the relevant District Courts.
  5. The Service Provider reserves the right to amend these Terms and Conditions. Any and all contracts for the provision of electronic services concluded before the effective date of the amended Terms and Conditions shall be executed on the basis of the Terms and Conditions that were in effect on the date of the contract for the provision of electronic services. The amendment to the Terms and Conditions shall come into effect within 7 days of publication on the Website. The Service Provider shall notify Users 7 days prior to the effective date of the new Terms and Conditions of the amended Terms and Conditions by means of an e-mail message containing a link to the text of the amended Terms and Conditions. If the User does not accept the new content of the Terms and Conditions, he is obliged to notify the Service Provider, which shall result in termination of the contract in accordance with the provisions of §8.
  6. The Terms and Conditions enter into force on .........
